Before being able to use our website or our Application,Nuna, you need to read and accept our Terms and Conditions. After acceptance there is a binding agreement between Nuna ApS (“Nuna”, “I”, “we” and “us”) and you. Afterwards, when using our service in any way means that you agree to our terms that are written in this document.

When agreeing to these terms and conditions you are agreeing to resolve any dispute between Nuna and you through an individual arbitration rather than in any type of court. Likewise, you are waiving your right for a trial by jury or to participate as a class member or plaintiff in any purported representative proceeding or class action.

1. The service

Nuna is solemnly designed as a self-helping program. It will never be a substitute for actual mental health services or any type of medical care.

If you’re facing serious illnesses or feeling that you can be a danger to yourself you should always call your national emergency hotline and/or call or schedule a meeting with actual mental health or other professional services.

2. Privacy

We are using different tools for our service. For our app and website, you can see our Privacy Policy here.

We are also using the Facebook messenger platform, which is a subject to Facebook’s own Privacy Policy you can see here.

We are restricting the use of Nuna from children below the age of 13 according to The Children’s Online Privacy Protection Act (COPPA). Therefore we do not knowingly collect or solicit identifiable information from children under the age of 13.

We ask children below 13 to not attempt to register to our services or send us any type of personal information.

3. Using Nuna

Our service runs through the app you can find on Apple Appstore or Android marketplace. Before being able to use the service, you are asked to provide a name/nickname, email, password and age. You may not impersonate other persons than you or use other persons accounts nor transfer your account to other people without a written consent.

Your password and account information must be protected for the security of your account and you shall not share the information . You are responsible for all activities associated with your account.

The service is made only for your own personal and non-commercial and not on behalf of any third party and you will therefore only use the service according to previous stated. If you fail to comply with those guidelines then we can’t and won’t be responsible for our ways of using our services in an illegal way.

All the content, data and all communication in regard to the service, our website or similar, is of property of Nuna ApS and you agree to not copying or “crawling” any page or data and/or decompile/ reverse engineer our service.

You agree that you will not distribute or contribute any content or user submissions or use/interact with the services in a way that:

• Violate any laws or regulations

• Is harmful, harassing, defamatory, obscene, fraudulent, deceptive or objectionable

• Violate or infringes the intellectual property rights or other rights of any third party including Nuna

• Risk the security of your Nuna account or anyone else’s

• Attempt to obtain account information from any other user

• Run any type of auto-responder or spam on our services or any other processes that are active while you are not logged into our service and or while you’re not actively using the service. This includes any form interference with our service that will place unreasonable big loads on our infrastructure.

By violating the above points or in general any of our terms of conditions it will be the grounds for termination of your access and rights to use our services.

4. Copyrights and trademarks

All the content (including text, visuals, photos, graphics, data, illustrations, audio, video, user submissions (etc. all under the term content)) is owned and copyrighted by Nuna ApS. You agree not to copy, re-use, modify, translate or any way of exploiting the content owned by Nuna ApS without prior consent from us.

As a part of our service we may link to videos and articles not creatued by us, of which we do not claim any ownership. For this content we do not take any responsibility for the content nor for any type of harm this content can cause.

5. Nuna is not giving medical advice

The use of Nuna is not for any kind of medical or mental health advice. Always seek your own therapist or healthcare provider if you have any questions regarding your health and/or mental health.

The content of Nuna has been written by medical professionals but the provision of the content does not create actual medical advice or any type of opinion in regard to your health. It is a self-help program based on an evidence proven therapy form, but is not a substitute for a real therapist and/or healthcare.

Our service is not, and should not be considered for actual medical/mental health advice or be a substitute for any individual diagnosis, medical advice or treatments.

The use of our service is solely on your own risk.

6. Change of Terms and/or Services

Sometimes our service will change as well as our Terms & Conditions. We reserve the right to change our Terms & Conditions at any time, but doing so, we notify all our users of our service. You do have the option to disagree with any new change of terms & conditions, but this will mean you will no longer be able to use ther services.

We also reserve our right to change our service and or edit or delete any content at any time but we will notify the users if the changes will affect them.

7. Membership and cancellation

Nuna is a free service and it is always possible at any time to delete your account and all your personal information through the “settings” menu in the app.

Nuna ApS are also free to terminate your account or use of our services at any time for any reason in our discretion – including a breach of our terms. We have the sole right to declare whether you’re in violation of any of our terms.

8. Apple App Store and Google Play Store Terms

The Nuna terms stated above apply to the use of our service on all the available devices for our application. The terms and conditions are between you and Nuna ApS and not between your and Apple or Google.’

Our application is licensed to you on a non-exclusive basis and is solely to be used in connection with your private, personal, non-commercial use which is subject to all our terms and conditions in this agreement.

9. Other terms

Assignment

These terms & conditions may not be assigned or transferred in any way without our written consent. Nuna ApS may assign or transfer these terms & conditions and our rights without consent.

Liability

Allowed by applicable law, under no legal theory and circumstances shall Nuna ApS be liable to you or any other persons for any kind of direct, indirect, special, consequential or incidental damage of any kind. This is including damages of loss of profits, loss of goodwill, accuracy of results, computer failure or malfunctions or work stoppage in excess of more than €80 or the amounts you have paid to Nuna in connection with the service the last 12 months preceding this applicable claim or any amount beyond our reasonable control.

Indemnity

You agree to indemnify and hold Nuna ApS and all employees, affiliters or other associated with Nuna ApS harmless for and against any type of claims, liabilities, losses, damages, expenses (fee’s) arising from any third party claims related to your use of our services.

Warranty Disclaimer

Our service and the content is without warranties, including implied warranties of merchantability, fitness for specific purposes, non-infringement, or that using our service will not be uninterrupted or error free.

We do not make any representations or warranties concerning our contained content in our services, and we will not be held responsible or liable in any ways for the accuracy, the compliance, the copyright or the material contained in or obtained through our service.
